II. PURPOSE AND SCOPE OF THE GENERAL TERMS AND CONDITIONS

These General Terms and Conditions are drafted and intended to regulate the relationship between "Orient Home Sofia" EOOD, registered in the Commercial Register at the Registry Agency with UIC: 207585188, with headquarters and management address in Sofia, zip code 1359, Lyulin district, bl. 411 entrance B, floor 1, telephone: +359 877 350 110, email: store@orienthome.org, and website: http://www.orienthome.org/, hereinafter referred to as the "Supplier", and the users of the website, hereinafter referred to as "User/s" in connection with the use of the website. These General Terms and Conditions also regulate the deliveries of any product purchased by the User who has contacted the Supplier through the use of this website. By ordering a product, the User agrees to be legally bound by a purchase and sale contract regulated by these General Terms and Conditions and applicable law.

  2. For the purposes of these General Terms and Conditions:

a/ Supplier is "Orient Home Sofia" EOOD.

b/ User/s is/are:

  • visitors to the website http://www.orienthome.org

  • the person who contacted the Supplier by sending a message through the contact form available on the website;

c/ Contact form is an electronically provided form accessible at http://www.orienthome.org/, the exhaustive completion of which is a condition for contacting the Supplier.

d/ Newsletter subscription is the inclusion of the User's email address in a list to which current information regarding the products offered by the Supplier is sent.

IV. SUBJECT OF THESE GENERAL TERMS AND CONDITIONS

  1. The Supplier has created the website http://www.orienthome.org/, which contains detailed information about the products offered by the Supplier to Users.

  2. The Supplier provides, and Users are obligated to use the website according to the conditions described in these General Terms and Conditions.

V. CHARACTERISTICS OF THE WEBSITE

  1. The website represents an e-commerce platform, created and owned by the Supplier.

The content of this website may not be copied and displayed without the explicit written consent of the Supplier.

The website has a specialized focus, namely the sale of lighting fixtures, bulbs, and similar goods via the internet network through individual customer orders. All prices listed on this website include VAT and do not include delivery charges!

All prices are valid until stocks are depleted or until changes in the Supplier's price list occur. The Supplier reserves the right to change prices without prior notice to its users, as well as to correct erroneous technical and other parameters of the goods. Printing errors, differences in color visualization due to user computer configurations, and changes in product designs are possible. The colors of each product are specified in the accompanying texts.

  1. The internet website includes comprehensive information regarding:
  • Information about the Supplier;
  • All types of products offered by the Supplier to Users;
  • Information for contacting the Supplier;
  • News published by the Supplier.

VI. REGISTRATION

  1. Registration on the website is voluntary and free of charge. To complete the registration, the User needs to select the "Registration" button and fill out the registration form.

  2. By completing the registration procedure, a User profile is created on the website. Access to the profile is granted through a username and password.

  3. The User confirms that the information provided during registration is accurate. The Supplier is not responsible for printing errors, as well as for inaccurately presented information or information presented in a misleading manner.

VII. PRICES AND PAYMENT METHODS

  1. The prices listed on the website do not include packaging and transportation to the buyer's address. The User is informed of the transportation cost before agreeing to or canceling the order.
  2. Payments for the ordered products can be made in one of the following ways:
  • via bank transfer, to the specified bank account of the Supplier;
  • through postal money order upon delivery.

VIII. ORDERS

  1. The products displayed on the Supplier's website do not constitute a legally binding offer but rather serve as a demonstrative online catalog describing the Supplier's product line.

  2. By clicking the "BUY" button, the User agrees to purchase the goods. This action has legal binding force. The User receives confirmation of the order, and upon receiving this confirmation, it is considered that the contract has been concluded.

  3. The User has the right to withdraw from the contract. The User may exercise the right to withdraw from a distance contract for financial services within a period of 14 days from the date of receipt of the goods by the consumer or by a third party other than the carrier and indicated by the User – in the case of a sales contract.

IX. DELIVERY

  1. The Supplier delivers the products ordered by the User to the address specified by the User. The Supplier carries out deliveries of the ordered products through selected courier companies. For each individual delivery, the Supplier provides a delivery price after the User has provided an address for the products to be delivered.

  2. Immediately after delivery, the goods should be carefully inspected by the User or an authorized person. Any damages, impacts, or other losses should be reported promptly to the Supplier. In case damages incurred during the transportation of the goods are detected, the Supplier is not responsible for the warranty service of these goods. If an incorrect or erroneous address, contact person, and/or phone number are provided when submitting the request, the Supplier is not obligated to fulfill the order.

  3. Upon delivery of the goods, the User or a third-party authorized person signs the accompanying documents. A third party is considered anyone who is not the titleholder of the application but accepts the delivery at the specified address provided by the User.

In case of refusal to receive the goods, except in the cases described below, the refusal is considered unjustified, and the User is liable to pay the delivery and return costs for the goods. If the User is not found at the specified address within the delivery time frame or if access and conditions for delivering the goods are not provided within this period, the Supplier is released from the obligation to deliver the requested purchased goods.

When the delivered goods clearly do not correspond to the goods requested for purchase by the User and this can be established through its ordinary inspection, the User may request that the delivered goods be replaced with goods corresponding to the purchase request made by them within 24 hours of receiving them.

X. WARRANTY

The Supplier provides a warranty document to its customers for a purchased product if such a document is provided by the manufacturer of the product. If no warranty document is provided by the manufacturer, the sales invoice serves as a replacement.

XI. COMPLAINTS

Complaint upon delivery, when the purchased goods do not correspond to the subject of the sales contract. Non-compliance may manifest as:

  • Sending goods different from those ordered;
  • Discovering missing parts from the order;
  • Visible manufacturing defects;
  • Damage during transportation.

The complaint should be made to the courier during the inspection of the goods. The User may, at their discretion:

  • Completely refuse the delivery without owing payment, in which case the order is considered canceled;
  • Allow the Supplier to correct the error through redelivery and pay the due amount after ensuring that the grounds for complaint have been eliminated.

The User must ensure that the contents of the order correspond to what was requested before accepting the shipment. Once the courier delivers the shipment to the customer, it is no longer possible to file a complaint for missing items in the order or damages during transportation. Complaints against sending goods different from those ordered or against visible manufacturing defects can be made within 15 calendar days of receiving the delivery.

XII. FORCE MAJEURE CIRCUMSTANCES

  1. The Supplier shall not be liable to the User for the complete or partial non-performance of the delivery of the ordered product/s, including delays in delivery or defects and/or damage to the product, if it is due to "force majeure." "Force majeure" is understood to mean an extraordinary circumstance (event) that has occurred after the conclusion of the contract, could not have been foreseen, and is not dependent on the will of the parties, such as: fire, industrial accidents, military actions, natural disasters – storms, heavy rains, floods, hailstorms, earthquakes, icing, drought, landslides, and other natural disasters, embargo, government bans, strikes, riots, unrest, etc.

  2. In case the Supplier becomes unable to fulfill its obligations due to a force majeure event, the Supplier undertakes to notify the User in writing of its occurrence within a 10-day period, as well as the presumed period of action and termination of the force majeure circumstance.

XIII. DISCLAIMER OF LIABILITY

  1. The information on this website may contain errors or inaccuracies, although the Supplier strives to keep the information up to date. The Supplier has the right to make changes and improvements to this website at any time. The Supplier does not assume responsibility for any errors or inaccuracies in the content of this website. The Supplier is not liable for damages and losses incurred by Users as a result of using this website and the materials from this website.

  2. The Supplier has the right to make changes to the products offered or to discontinue the offering of some of the products offered.

XIV. PERSONAL DATA PROTECTION

  1. The Supplier understands the concerns of the Users of this website regarding the protection of personal data and is committed to protecting their personal data by applying all standards for the protection of personal data. When collecting and processing personal data, the Supplier collects and processes personal data provided directly by the User, for whom the data applies, and which are necessary for creating a user profile, sending promotional emails, as well as contacting the User by phone or email to provide an offer or information about a specific product.

  4. The Supplier collects and processes only the following data related to the physical identity of the User:

  • Name;
  • Email address;
  • Phone number.
  1. Users have the following rights, namely:
  • Right to information;
  • Right of access to collected and processed personal data;
  • Right to correct inaccurate personal data;
  • Right to erasure of personal data;
  • Right to restriction of processing of personal data;
  • Right to data portability;
  • Right to object to processing of personal data;
  • Right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning the User or similarly significantly affects them;
  • Right to be notified of a personal data breach;
  • Right to judicial and administrative protection;
  • Right to compensation for damages suffered.

  1. Users have the right, when entering their personal data, to choose that the provided data be used for direct marketing purposes. If the User has given their consent for their personal data to be used for direct marketing purposes, they may withdraw their consent at any time by notifying the Supplier.

  2. The Supplier has the right to disclose the processed personal data to the following categories of persons, namely:

  • to the Users, for whom the data applies;
  • to persons, if provided for in a regulatory act;
  • to courier companies performing the delivery of the ordered products.

XV. LINKS TO THIRD-PARTY WEBSITES

  1. The Supplier's website contains links to internet pages maintained by third parties ("Third-Party Websites"). The Supplier is not responsible for the content on third-party websites, as well as for the presence of viruses, other harmful components on these websites, including damages caused by the use of third-party websites.

XVI. NEWSLETTER SUBSCRIPTION

   Subscribing to the newsletter involves the User entering an email address into a list to which current information about the products offered by the Supplier is sent. Users have the right to unsubscribe from the list they are included in. The newsletter is distributed free of charge, and the Supplier is in no way obligated to regularly send newsletters when subscribing.

XVII. INTELLECTUAL PROPERTY RIGHTS. USAGE RESTRICTIONS

  1. The entire content of the website, including, but not limited to, all published texts, photos, images, illustrations, graphics, computer programs, as well as any information uploaded to the website, is the exclusive property of the Supplier.

  2. Trademarks (registered or unregistered) published on the website are protected by applicable law. Nothing in these Terms and Conditions should be construed as permission to grant the right to use the trademark.

  3. The content of the Supplier's website may only be used by Users of the website for personal, non-commercial use.

  4. The use of information contained on the website for commercial purposes, in any form (copying, modifying, downloading, selling, creating derivatives of protected works, reproduction, distribution, publication, transmission, etc.) is strictly prohibited. Users bear full responsibility for using the content of the website in violation of the Supplier's rights, and the Supplier is entitled to full compensation for damages caused by the User.

XVIII. FINAL PROVISIONS

  1. All messages and notifications between the Supplier and the User will be considered validly executed if sent to the email addresses specified below:

For the User: the email address provided in the Application;

For the Supplier: store@orienthome.org.

If either party changes their email address without notifying the other party, the latter is not responsible for messages, notifications, and similar not received.

  1. The possible invalidity of any of the provisions of these General Terms and Conditions shall not invalidate the General Terms and Conditions as a whole.

  2. All matters not regulated in these General Terms and Conditions are governed by the provisions of Bulgarian civil and commercial law.

  3. All disputes between the Supplier and the User arising from these General Terms and Conditions and the concluded individual agreements shall be settled amicably through negotiations between the parties. In the event of failure to reach an agreement, the dispute shall be referred to resolution before the competent court.

  4. In case of discrepancy between these General Terms and Conditions and the provisions of the individual agreement between the Supplier and the User, the clauses of the individual agreement shall prevail.

  5. The Supplier has the right to update by amending and supplementing these General Terms and Conditions at any time in the future. When this happens, the amended General Terms and Conditions will be published on this website with a new "Last Change" date at the top and will take effect from the date of publication. Therefore, it is advisable to periodically check these General Terms and Conditions to ensure that you are familiar with all changes. The use of the website after the publication of the updated General Terms and Conditions will be deemed as your agreement to the changes made.

  6. These General Terms and Conditions were adopted on 03.2024 and enter into force for all Users on 03.2024.
